By accessing or using the Site, you agree to comply with and be legally bound by these Terms and Conditions, our Privacy Policy, and other applicable legal notices and policies published by us.  You agree to conduct yourself in a respectful, lawful, and responsible manner at all times .If you do not agree with these Terms, please refrain from using this Site.

2.1. You agree to use this Site only for lawful purposes. You may not use this Site in any way that:

3.1.2. Legal advice is only given through formal consultations, which may be subject to a fixed fee or hourly rate, as agreed upon by the parties in writing.

3.1.3. Information shared via blog content, newsletters, or general website content does not constitute formal legal advice and should not be relied upon as such.

 

3.2. Contract Drafting and Review:

3.2.1. We draft and review a wide range of legal contracts and agreements, including but not limited to:

3.2.1.1. Service agreements;

3.2.1.2. Employment agreements;

3.2.1.3. Lease agreements;

3.2.1.4. Sale agreements;

3.2.1.5. Non-disclosure agreements.

3.5.2. Please note we do not provide formal representation at CCMA or Labour Court unless otherwise advised.

 

3.6. Company Retainers

3.6.1. Businesses may enter into monthly service retainers which may include:

3.6.1.1. A fixed number of consultations;

3.6.1.2. Access to legal templates or policy documents;

3.6.1.3. Ongoing HR or compliance support;

3.6.1.4. Document drafting and review services;

3.6.1.5. General business legal advice.

3.6.2. Each retainer is governed by a separate written agreement outlining the scope, billing cycle, and limitations.

 

3.7. Educational Content & Legal Resources

We may from time to time provide general educational resources, blog articles, templates, or downloadable content. These materials are provided for informational purposes only and do not substitute legal advice. Use of any educational content or templates is at your own discretion and risk. 

4. Intellectual Property

4.1. Ownership of Content

All content and materials available on this Site — including but not limited to text, documents, templates, downloadable files, graphics, logos, icons, audio, video, software, code, design elements, and data compilations — are the exclusive property of CJP Legal Services,  its licensors, or content providers. These materials are protected by South African intellectual property laws, including the Copyright Act 98 of 1978, the Trade Marks Act 194 of 1993, and other applicable international treaties.

 

4.2. Trademarks and Branding

All trademarks, trade names, service marks, logos, and branding displayed on this Site are the registered and/or unregistered intellectual property of CJP Legal Services or third parties authorised by CJP Legal Services. You may not use, reproduce, imitate, or modify any such marks without prior written consent from CJP Legal Services or the rightful owner.

 

4.3. Restrictions on Use

You are granted a limited, non-exclusive, non-transferable, and revocable licence to view and use the Site and its content strictly for personal or internal business use only. You may not:

CJP Legal Services vigorously protects its intellectual property rights and reserves the right to take legal action, including civil and/or criminal proceedings, against any person or entity found to be infringing upon those rights. This includes claims for damages, interdicts, and legal costs on an attorney-and-own-client scale.

 

4.7.  No Transfer of Rights

Nothing in these Terms shall be construed as granting you any right, title, or interest in or to any intellectual property rights belonging to CJP Legal Services, except as explicitly permitted under these Terms.

5. Disclaimer of Liability

5.1. Use at Own Risk

The content, documents, templates, and information provided on this Site are for general information purposes. By using this Site, you acknowledge and agree that any reliance on such information is entirely at your own risk.

 

5.2. No Legal Advice

Unless explicitly stated otherwise, no content on this Site shall be construed as legal advice or the creation of an attorney-client relationship. 5.3. No Warranties

5.4.  Limitation of Liability

To the maximum extent permitted by law, CJP Legal Services, its directors, stakeholders, employees, agents, contractors, licensors, and affiliates shall not be held liable for any direct, indirect, incidental, special, punitive, or consequential loss or damages of any kind, whether in contract, delict (including negligence), or otherwise, arising from:

5.4.1. Your access to or use of, or inability to access or use, the Site;

5.4.2. Reliance on any content, documentation, or material provided through the Site;

5.4.3. Errors, omissions, delays, or inaccuracies in any information or content;

5.4.4. Any decisions made or actions taken based on the content of this Site;

5.4.5. Any virus, bug, malware, or other technological harm resulting from the use of this Site.

You agree to indemnify and hold harmless CJP Legal Services, its directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or any violation of applicable law or the rights of a third party.

 

5.7. Force Majeure

CJP Legal Services shall not be liable for any delay or failure in the performance of any part of the Site due to events beyond its reasonable control, including but not limited to acts of God, war, sabotage, pandemic, power failure, internet outages, system failure, or actions of regulatory authorities.

 

5.8. Applicable Law

Nothing in this Disclaimer of Liability shall be interpreted to exclude or limit any warranty or liability which cannot be excluded or limited under applicable South African law.

6. Privacy

6.1. Our Privacy Policy, available on the Site, form part of these Terms.

6.2 By using the Site, you consent to the collection, use, and storage of your personal information as outlined in those documents and in compliance with POPIA and other applicable data protection laws.

7.1.  CJP Legal Services reserves the right to modify, amend, update, or revise these Terms and Conditions, the Privacy Policy, or any other legal notices or policies on the Site at any time and for any reason, without prior notice to you.

7.2. Any changes will become effective immediately upon being posted on the Site. It is your responsibility to review the Terms regularly to ensure you remain informed of any updates.

7.3. Continued use of the Site following the publication of updated Terms shall constitute your full acceptance of those changes. If you do not agree to the amended Terms, you must stop using the Site immediately.

7.4. CJP Legal Services may also update or discontinue features, services, or functionality of the Site, either temporarily or permanently, with or without notice. We are not liable for any modification, suspension, or discontinuance of the Site or any part thereof.

8. Booking and Payment

8.1.  Booking Procedure

All service bookings must be made through our official communication channels, including Company Website / Contact Form / Email / WhatsApp / Booking Platform. No booking will be confirmed unless expressly accepted by CJP Legal Services in writing.

 

8.2. Quotation and Acceptance

Upon receiving a booking enquiry, CJP Legal Services will provide a written quotation outlining the scope of services, estimated fees, and any applicable timelines. Acceptance of the quotation must be confirmed in writing and shall be deemed to form a binding agreement, subject to these Terms and Conditions.

 

8.3. Payment Terms

Unless otherwise agreed in writing:

8.3.1. A 50% deposit is payable upon acceptance of the quotation to secure your booking;

8.3.2. The balance of the fee is payable before service delivery;

8.3.3. All invoices are payable in South African Rands (ZAR), via EFT or other approved methods.

 

8.4.  Late or Non-Payment

8.4.1. Failure to make payment by the due date may result in:

8.4.1.1. Suspension or cancellation of your booking without further notice;

8.4.1.2. Withholding of any work product, documents, or deliverables;

8.4.1.3. Accrual of interest on overdue amounts at 2% per month, compounded monthly;

8.4.2. Recovery of legal and collection costs on an attorney-and-own-client scale, should enforcement become necessary.

 

8.5. Refund Policy

All payments are non-refundable unless CJP Legal Services cancels the booking or is unable to render the agreed services. In such cases, you will be entitled to a pro rata refund of any unused portion of fees paid.

 

8.6.  Cancellations and Rescheduling

Cancellations must be made in writing at least 48 hours prior to the scheduled service. Late cancellations may incur a cancellation fee or result in forfeiture of your deposit. Rescheduling is subject to availability and must be confirmed in writing.

 

8.7.  Proof of Payment

It is your responsibility to provide proof of payment and ensure that payment reflects in our bank account by the due date. Booking confirmation and service delivery may be delayed until payment is confirmed.

 

8.8. Right to Refuse Service

CJP Legal Services reserves the right to decline or cancel any booking at its sole discretion, including but not limited to instances of non-compliance with these Terms or suspected fraudulent activity.

9. Discounts and Promotional Offers

From time to time, CJP Legal Services may run promotional offers, discounts, special pricing, or bundled deals on selected  services for a limited period. All such offers are subject to the following conditions:

9.1. Validity Period – Each promotional offer will clearly state its start and end date. No discounts will be applied outside of the specified promotional period.

9.2. Eligibility – Promotional offers apply only to qualifying services, as stated in the specific offer details. We reserve the right to verify eligibility before honouring a discount.

9.3. Non-Transferable – Discounts, vouchers, or promotional codes are non-transferable, have no cash value, and may not be redeemed for cash or credit.

9.4. One Offer Per Transaction – Unless expressly stated, promotions cannot be combined with any other offers, vouchers, or discounts.

9.5. Application of Discount – Discount codes, if applicable, must be entered correctly at checkout to qualify. We are not responsible for customer error in failing to apply the code before purchase.

9.6. Changes and Cancellations – We reserve the right to amend, withdraw, or cancel any promotional offer at our sole discretion without prior notice, in which case no further claims will be entertained.

9.7. Misuse of Offers – Any suspected misuse, manipulation, or abuse of a promotional offer will result in cancellation of the order and possible restriction of future purchases.

9.8. By participating in any promotional offer, customers agree to be bound by these terms in addition to our standard Terms and Conditions.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit to the exclusive jurisdiction of the courts of South Africa for any dispute arising out of or relating to these Terms or your use of the Site.
